is it illegal to carry a knife? a big one?
I know this is really stupid but i found this huge knife, probably a 10 inch blade, one of those navy seal knife things, under my seat in my car. i had no idea it was there, I used it fishing maybe a year ago and it musta slipped there.
It got me thinking fi I got pulled over and searched, I could have gotten screwed?
so can anyone tell me what the law is for having a knife like say i'm going fishing and i have a knife with me, or i have one in my car, does it matter the size? or is it not legal to have? I imagine I can't go walking about town with this knife in my pocket!
You would have to check your state laws, but here in Ohio, any knife with a blade length exceeding 2 1/2 inches is considered a deadly weapon. If you notice, most pocket knives are made and sold with 2 1/2 inch blades or less for that reason.
The worst part of your scenario is stating it was under the seat of your car. That would mean it would be accessible to you from the driving position.
An Officer is allowed to "search" the visible areas of your car without consent. That means what is sitting on the seats or under the seats. If you were pulled over and he pulled out a 10 inch knife, I cant imagine that he would not arrest you.
But, as I said at the beginning, check your local and state laws. Maybe this is allowed in your jurisdiction. But better safe then sorry. The first thing a Judge will tell you is: " Ignorance of the law is no excuse".
