what makes a knife illegal to be carried in public?
what makes it illegal to carrie a knife in public? i know switchblades if they are concealed, i don't know of any length limitations and i think spring action knifes are ok. this is in maryland , not DC
I'm an avid knife collector in MD and I've been researching these laws and case law for years.
Basically, under state law you can carry a FOLDING knife so long as it is not a switchblade. A so-called "assisted opening" knife is legal and counts as a folding knife, as does a butterfly knife in Maryland. Folding knives are known in state law as "penknives" and according to a supreme court case called Mackall v. State in 1978 ruled that "penknife" is any knife that folds into it's handle, no matter how large. The force of this decision was so binding that in 2002 a police officer tried to arrest a guy for a folding knife that was 3 inches long, and the officer was tried in Federal court for false arrest and lost his badge as a result (because the court felt the officer should have known better considering the decision was 30+ years old)
You generally cannot carry fixed blade knives concealed, though intent plays a part in this. I advised a fellow last fall who was arrested for two fixed blade knives he carried under his shirt, and the court dropped the charges against him because it was evidence from his behavior that he wasn't up to anything. He was an older fellow who used them for woodcarving.
If you are a minor in certain counties, you cannot carry a fixed blade at all during the nighttime unless you are on a hunting trip. There are possibly some county and city laws that may restrict the carry of knives further, but in my travels these have been very rare.
