Virginia Knife Laws? Confused?
Ok, i get it that I can't carry around a bowie (K-bar for those who don't know. Its in my car instead) or a butterfly knife. Switchblades are just straight up illegal. However, the length and the legality of concealing a knife is where I become confused. I understand where I can and cannot carry a weapon (remember, knives specifically) but I have no idea if i need a concealed weapon's permit or not. I've also heard that i can/cant/can/cant ETC, ETC... have a blade longer than 3.5 inch in public. I've tried reading the 18.whatever law (criminal law basically) on it but I became confused since it talked about what concealment meant, but its not really concealed... Please, someone tell me if I can legally carry a 10 3/4" blade around (fixed blade, sheathed) concealed, not concealed and if I need to get a permit. Thank you. I'm an adult, just to clear that up.
The length really does not matter for knives (unless there is a local city law). It may surprise you to know that very few states around the USA actually have laws about how long the knife can be, but each state often has an "urban legend" length rule, some even held by cops!
Basically, you can "open carry" fixed blade knives in Virgina, no matter how large it is, even bowie knives and daggers. Open carry means it is clearly visible to other people. If you are talking to them during a normal conversation, they should be able to tell you have a knife. It can be in a sheath, it just has to be clear it is in fact a knife to a person who sees it.
Concealed, it should be a folding knife. There is no length limit, just that it cannot be a switchblade. It is possible, I guess one could say, to carry a fixed blade concealed, but this is extremely shaky ground because if the knife has the characteristics suggesting it is a weapon, it can be considered a "weapon of like kind" if it is concealed. For example in a recent case, a guy had a single-edged "tanto" style knife concealed on him. He was convicted because it is a weapon design and he said it was "for protection" meaning he considers it to be a weapon.
Interestingly enough, there was another recent case where a guy had a butterfly knife concealed, and he was found innocent. This was because the law does not actually contain anything about butterfly knives, and because the guy said he used it for work, along with the pliers he carried, so it was not intended as a weapon, and therefore it was not "a weapon of like kind."
