Milwaukee knife laws/ regulations regarding spring loaded knifes.?
I live in shorewood WI, a sub of mil, WI. i have a gerber spring loaded knife, "fast draw" to be precise, and i am still not sure if i can legally carry it around, not to school of course. I've read the city law regarding weapons but am still unsure.
for those who aren't familiar with the knife, it has a thumb knob and when pressure is applied to the knobs the spring takes over and does the rest for you. the blade can be locked both closed and open. THe blade itself is less that 3 in in length, which is with in legal restrains, the only questionable part is the spring portion.
Winconsin's switchblade law is worded kind of funny. It is a "knife having a blade which opens by pressing a button, spring or other device in the handle or by gravity or by a thrust or movement." On it's face, this law bans true switchblades (which have switches), a now nearly extinct knife known as a "gravity knife" (the blade slides out using inertia after a button is pushed, the nazi paratroopers carried them) and Balisongs (aka "butterfly knife").
Milwaukee City Law narrows it down thus:
"any knife which has a blade that may be drawn without the
necessity of contact with the blade itself or is automatically opened by pressure on the handle or some other part of the knife"
Technically speaking, it would seem the law specifies that there be some kind of switch, or that the knife simply flip open by being swung a certain way. The Gerber fast draw does neither: You have to physically push the blade out. It would seem that like most other states, spring assisted knives in WI once again fall through the loophole they were created for.
